A WIN IN THE U.S. SIXTH CIRCUIT COURT OF APPEALS. On August 18, 2014 in Nifadev v. Holder, (Case No. 13-3704/4222
6th Cir. 2014), the United States Court of Appeals for the Sixth Circuit held that Mikheil B. Nifadev has proven his claim that he
had suffered persecution by reason of his Russian ethnicity at the hands of the security and regular police of Uzbekistan. The
Court vacated the decision of the Board of Immigration Appeals (BIA) in Washington, D.C. which had denied Mr. Nifadev asylum,
and the Court remanded the case with additional instructions to the United States Attorney General, including that the BIA should
determine whether the BIA should also reconsider its denial of Nifadev’s application for withholding of removal and protection
under Convention Against Torture (abbreviated CAT for Convention Against Torture And Other Cruel, Inhuman or Degrading
Treatment or Punishment of the United Nations) in light of the opinion of the Court. The Sixth Circuit opinion essentially and
explicitly held that "[b]ecause the IJ [Immigration Judge] appears to have erred in her determination that Nifadev did not suffer
past persecution and because the IJ clearly misinterpreted Nifadev’s credible testimony regarding the ethnic animus of the
Uzbekistan security officials, we find that Nifadev has made out a credible case of being a refugee under the definitions of
8 U.S.C. § 1158(b)(1)(A)." [Emphasis added]. The United States Immigration Court in Cleveland, Ohio, had initially
found Mr. Nifadev and his witnesses to be credible but declined to grant asylum because it erroneously determined that
Mr. Nifadev had NOT suffered persecution. Shown in photograph on the right is Mr. Mikheil B. Nifadev with Charleston

Pursuant to the Sixth Circuit opinion, the BIA on January 5, 2015, ordered the Immigration Court to grant asylum to Mr. Nifadev.

A Note On Posse Comitatus & Sanctuary Cities
The purpose of the Posse Comitatus Act in concert with the Insurrection Act of 1807 is to limit the powers of the United States government in using federal military personnel to
execute laws domestically within the United States. It was passed as an amendment to an army appropriation bill following the end of Reconstruction, and was subsequently
updated in 1956 and 1981. Interestingly, it is a felony offense punishable with up to two years imprisonment to violate the Posse Comitatus Act.
I mention Posse Comitatus because the issue has recently come up in our border states especially to the south. What is the role for federal troops regarding undocumented
immigrants present within the USA? Is the enforcement of immigration laws execution of laws domestically? The bulk of our immigration statutes and regulations are
administrative or civil in nature, some very few pertain to misdemeanor and even fewer to felony offenses. I think it is and therefore Posse Comitatus prohibits the use of the
U.S. military to track and arrest those entering without inspection properly through the Customs and Border Protection or more broadly all undocumented aliens present in our
Nation. It is important to restate here that immigration law is mostly preempted by the U. S. Congress and that the making of immigration policy is a federal prerogative. See,
Arizona v. United States (U. S. Supreme Court 2012).
The next question then is "can the feds form a posse of local police to enforce immigration law? " The answer is YES. The process is authorized by Section 287(g) of the
Immigration and Nationality Act - Delegation of Immigration Authority. The feds and the local police must first sign a MOA (Memorandum of Agreement) and local officers must
complete training and work under the supervision of ICE. It is not an ad hoc posse in the tradition of the sheriff of old west calling up a force of armed posse from the Main
Street saloon because the bank was just robbed and the clerk shot. For the official ICE webpage, please see

The flip question is "can a local police agency decline to enforce federal immigration law?" This is the heart of the great debate concerning sanctuary cities. A very closely
related question is can the "can ICE compel a local police agency to do its will?" This immediately raises serious Constitutional issues under Tenth Amendment especially when
it comes to the state police and the national guard (which are under the command of the several Governors until "federalized"), So if the feds cannot compel by reason of the
10th, can a local police agency elect to decline? I think the answer is YES. It is also axiomatic that, as a starting premise, a sovereign does not execute the criminal law of
another. Can the President then order that funding be cut against that political subdivision?
You tell me! Fascinating isn't it? Brush up on your knowledge of federalism, state rights, and of course Posse Comitatus. Ultimately, I think it is about the limits on the

Dr. David Dao is a Real American Hero
On Sunday April 9, an Asian American passenger was brutally removed from his seat, screaming and blood covering his face, by United Airlines at Chicago’s O’Hare Airport. Since then, the whole
world has witnessed the violence through the internet and is struggling to understand how United Airlines could use such force against a paying customer.
Worse yet, United Airlines CEO publicly issued an “apology” for having to “reaccommodate these customers” and at the same time circulated internal memo to its employees justifying the violence as
“an upsetting event to all of us here at United,” but that the employer “emphatically stands behind all of you and I commend you for continuing to go above and beyond to ensure we fly right.”
Can United Airlines lawfully use this kind of force to remove a passenger that has boarded and taken his assigned seat?
In my opinion, United Airlines does not have that right. Four United Airlines crew members claimed privilege to bump off passengers already seated on a plane preparing for take-off. The company
used violence on a man who had as good a reason to be on this plane as the four United employees. United Airlines was wrong to bodily drag him off the plane screaming, bloodied and finally silent.
The whole story about an overbooked flight, circulated through the mainline media seems a pretext to me – it appears from some gross mismanagement, these four crew members suddenly showed
up at the last minute before take-off without prior notice i.e. they never booked themselves on this flight. Nonetheless United Airlines decided for its selfish business reason, that their crew had more
right to be on that plane than the paying customer after he had been allowed to board and take his assigned seat. Otherwise why did United Airlines board and seat all the passengers? It seems
obvious to me that United Airlines had no idea these four crew members existed in Chicago until they unexpectedly showed up without prior notice because they were late getting to Louisville. Not
once did management consider other alternatives to get their tardy crew to Louisville even by flying with another airline or by chauffeured limo, so they can work a flight on the next day, Monday.
United Airlines is blatantly over-reaching to continue to call this flight “overbooked.”
In my opinion, the incident was a wrongful assault which caused serious injury, specifically a concussion, broken nose, and missing teeth. Arguably United Airlines had the contractual right to refuse to
board any customer, but this Asian American passenger already had been permitted to board and was comfortably in his assigned seat with every expectation to arrive home. Arguably, United
Airlines has the power under aviation regulations to remove certain passengers for cause. The other convenient standby is “flying right” which encompasses ensuring the safety of the flight. However
this bloodied and humiliated passenger had never been a safety risk. All he wanted to do was to get home and to work the next day. There is no reason to treat him like a resisting criminal. All he was
doing was trying to say he had a right to his seat and he did say he was calling his lawyer. At that time and on that flight, he was accompanied by his wife. No need to silence him and drag him off
like some animal, or charitably, excess luggage. No, United Airlines has no such authority anytime, anywhere. This leaves open the very disturbing question, why did they use so much force – was it
because he was Asian in appearance? Did United Airlines operate under the stereotype assumption that he was easier to throw off the plane? To the contrary, as a paying passenger who had
boarded and taken his assigned seat on an United Airlines flight Dr. David Dao cannot be deprived of his civil rights to travel from Illinois to Kentucky where he resides.
The legal aspects and arguments aside, there are the business operations to consider. Sure employees are vital to a company’s success, but can a company continue to accommodate its employees
when it has no customers? Especially United Airlines when it is dreaming making money from the large China market.
Dr. David Dao definitely does not fit the stereotype of the docile, compliant model minority American of Asian ancestry, Dr. David Dao is a real American Hero. Some have compared him to Rosa
Parks and her bus ride, but respectfully I have to say not quite but yet more. Dr. David Dao held on to his seat on United Airlines while others have and would obey a greedy airline concerned only
about its bottom line. Dr. David Dao has shown the whole world that airline passengers are not pieces of unwelcome luggage but instead are flesh and blood human beings who bleed when
assaulted and have feelings when humiliated. Because of Dr. David Dao change for the better will come for United Airlines and to the airline industry as a whole. Yes, he is not a perfect human
being but Dr. David Dao is a real American Hero. He has shown America that Asian Americans are not docile compliant sheep but are human beings with a backbone. Dr. David Dao is a real
American Hero because what he did will benefit all airline passengers regardless of color, race, national origin, etc.
Finally, the incident itself certainly was an outrage felt not only by the violated passenger, the other passengers, and indeed many in the world, especially in Asia. In my opinion, the position
stakedout by United Airlines after the outrage just makes it mile high worse. United Airlines owes this Asian American passenger not only an apology. United Arilines may be trying to put out a
broader apology, but it is at best damage control too late. Another attempted damage control that is apt to backfire is the offering of cash payment to all the passengers on Dr. David Dao's flight.
What purpose did United Airlines have in mind? To compensate the passengers for the emotional distress they suffered seeing Dr. David Dao brutalized? I submit quite to the contrary - in fact all
these passengers are witnesses to the assault and sooner or later the whole world will react to this cynical and not so subtle effort by United Airlines to purchase favor. In the final analysis, Dr. David
Dao deserves his day in court and have all the evidence of the assault before judge and jury.
